The Employment and Labour Relations Court has ordered Kenya Methodist University to reinstate and pay 60 of its employees whose contracts were terminated in May.
The 60 were employed on diverse dates and served in various capacities as academic staff, administrative and support establishment personnel.
KeMU issued an internal memo to staff dated May 22 saying the institution was going through a restructuring process to improve its services and become more competitive.
Each of the 60 received a letter saying their services had been terminated because they were redundant. They said the university had failed to disclose the criteria used to declare them redundant and added that the institution failed to comply with the condition of Section 40(1)(c) of the Employment Act 2007.
“The criteria must be shown to have been uniformly applied to all the employees towards identifying those that are to be removed or retained,” said Justice Byram Ongaya in his judgement.
